SAN ANGELO — Two teens were arrested on suspicion of filming an autistic student in a restroom at Central High School and uploading the video to Snapchat and Instagram, according to an arrest affidavit.
Officers with the San Angelo Police Department arrested two boys, 17, on Wednesday, April 11, 2018, after receiving a report one had taken a video of another teen using the restroom and uploaded the video to a closed group on social media.
A second teen was arrested on allegations of taking the same video and uploading it to another closed group on Instagram, the arrest report stated.
Both face charges of improper photography or visual recording in a bathroom or dressing room, a state jail felony punishable by 180 days to two years confinement.
After speaking with assistant principals at Central High School, officers learned the student in the video was diagnosed as having autism, according to the arrest report.
Officers reviewed the video and "observed the victim with his genitals exposed," according to the arrest affidavit.
The boy who was videotaped told police he had not been aware he was being recorded, the affidavit states.
The San Angelo Police Department made the following statement on a Facebook post reading: A person commits an offense if, without the other person's consent and with intent to invade the privacy of the other person, the person:
Both teens waived their Miranda rights and spoke to police. One said he took the video and posted it to Snapchat, and the second teen said he shared it on Instagram, according to the affidavit.
Each teen was released from custody Wednesday on a $5,000 surety bond, according to an online jail bookings report.
An SAISD official said the district could not disclose details about the incident and any possible punishment.
"SAISD follows student code of conduct policies in all disciplinary instances," said Director of Communications Derrick Jackson. "This is an open and ongoing law enforcement situation and legal investigation. Rest assured all impacted parties in this situation have been notified and there was never a threat to the safety of the school."
